Terms of Service

1. Agreement to Terms

By accessing http://z3x.f8d.mytemp.website or using any service offered by FarmUS Health Services LLC (“FarmUS,” “we,” “us,” or “our”), you agree to be legally bound by these Terms of Service. If you do not agree, do not use our services.

2. Nature of Services — Forensic/Administrative Only

All services provided by FarmUS are forensic and administrative evaluations only. They do NOT constitute:

• Medical diagnosis, medical treatment, or psychotherapy
• An ongoing therapeutic or provider-patient treatment relationship
• Crisis intervention or emergency mental health services
• Legal advice or representation before the VA or any other agency
• A guarantee of any VA claim approval, disability rating, or benefit outcome

3. Independent Medical Opinions

All reports, Nexus Letters, and IMEs represent independent medical opinions based on available records and clinical interview at the time of evaluation. These opinions are not guarantees of VA acceptance, approval, or any specific rating outcome, and are prepared solely for VA disability claims documentation purposes.

4. Eligibility

• Must be at least 18 years of age and legally competent to contract
• Must be a U.S. military veteran, or an authorized representative, VSO, or accredited attorney/agent acting on behalf of a veteran
• Must reside in a jurisdiction where the treating provider is legally authorized to practice at the time of service
• Must provide accurate, complete, and truthful information throughout the intake and evaluation process

5. Payment Terms

• Payment is due in full prior to commencement of services
• All prices are in U.S. dollars
• By purchasing, you agree to the chargeback waiver set forth in our Refund Policy

6. Client Obligations

• Provide accurate, complete, and truthful information in all intake forms and evaluations
• Submit all requested documents in a timely manner
• Attend scheduled telehealth evaluations punctually
• Not record any telehealth session without prior written consent from the treating provider

7. Intellectual Property

All reports and evaluation documents remain the intellectual property of FarmUS Health Services LLC until payment is received in full. Upon full payment, client receives a non-exclusive, non-transferable license to use the report solely for their VA disability claim. Unauthorized reproduction, resale, or commercial use is strictly prohibited.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FARMUS HEALTH SERVICES LLC SHALL NOT BE LIABLE FOR any VA claim decision or outcome; indirect, incidental, or consequential damages; technology failures beyond our reasonable control; actions by the VA or government agencies; or misuse of any report by client or their representative.

Our total aggregate liability for any claim shall not exceed the total amount paid by the claimant for the specific service giving rise to the claim.

9. Disclaimer of Warranties

SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. FARMUS EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT SERVICES WILL RESULT IN ANY PARTICULAR VA OUTCOME.

10. Indemnification

You agree to indemnify and hold harmless FarmUS Health Services LLC, its officers, and agents from any claims, damages, or expenses arising from your use of our services, breach of these Terms, misuse of any report or document, or any third-party claim related to your VA proceedings.

11. Dispute Resolution and Arbitration

1. Informal Resolution: Contact us at support@farmushealthservices.com. We will attempt to resolve disputes informally within 30 days.
2. Binding Arbitration: If informal resolution fails, disputes shall be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules, in Harris County, Texas.
3. Class Action Waiver: You waive any right to participate in class action lawsuits or class-wide arbitration against FarmUS.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Subject to the arbitration clause above, exclusive jurisdiction lies in the courts of Harris County, Texas.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. Continued use of our services constitutes acceptance of revised Terms.
