  1. Confidentiality and Compliance with Privacy Laws
    • All telehealth services FarmUS Health Services provides fully comply with HIPAA, HITRUST, and relevant state and federal privacy laws.
    • Independent medical opinions conducted via telehealth will involve collecting and reviewing personal health information, which will be handled following strict privacy standards.
    • PHI will not be disclosed to third parties without the patient’s explicit written consent, except as required by law (e.g., court orders or public health requirements).

  1. Collection of Information
    • During telehealth IMOs, we collect personal and medical information necessary for the assessment, including medical history, service records, and relevant documentation.
    • We may also collect information from other health professionals, legal representatives, or family members with the patient’s consent.

  1. Use of Information
    • The information collected during telehealth consultations will be used solely to prepare an independent medical opinion.
    • The IMO will be based on the patient’s data and other records, ensuring the opinion’s accuracy and relevance to the patient’s condition.
    • Information will only be shared with requesting parties (e.g., insurance companies, attorneys, or employers) if permitted by the patient and relevant privacy regulations.

  1. Data Security
    • Telehealth services are conducted on secure, HIPAA-compliant platforms, ensuring encryption and protection of data during transmission.
    • Personal health information will be stored securely in encrypted databases, with access restricted to authorized personnel only.
    • We implement appropriate technical and organizational measures to protect PHI from unauthorized access, breaches, or accidental loss.

  1. Patient Rights
    • Patients can request access to their medical records and the independent medical opinion provided during telehealth consultations.
    • Patients can request corrections to any inaccuracies in their medical records.
    • Patients have the right to revoke their consent for using or sharing their information, except when required by law or for processing an already-issued IMO.

  1. Retention of Information
    • PHI collected during telehealth sessions will be retained following medical record retention laws.
    • Once the retention period has expired, PHI will be securely disposed of or anonymized to ensure privacy.

  1. Third-Party Access
    • Third parties, such as insurance companies or attorneys, will only have access to telehealth sessions if specifically authorized by the patient.
    • When third-party requests are made, all parties accessing or receiving medical records must adhere to the same privacy and security standards outlined in this policy.

  1. Emergency Situations
    • Telehealth services are not intended for medical emergencies. If a medical emergency occurs during a telehealth consultation, the session will be terminated, and the patient will be instructed to seek immediate in-person care.
    • In such cases, FarmUS Health Services may be required to share limited personal information with emergency responders to ensure the patient receives appropriate care.

  1. Complaints and Inquiries
    • Patients with questions or concerns about how their information is used or protected may contact FarmUS Health Services at support@farmushealthservices.com.
    • Complaints regarding potential privacy violations will be thoroughly investigated, and corrective actions will be taken if necessary.

  1. Updates to Privacy Policy
    • This privacy policy may be updated periodically to reflect changes in legal requirements or organizational practices. Patients will be notified of significant changes and provided with updated policy documents.
